Patna police seek custody of Hasan Ali
Hasan Ali Khan is wanted in the passport forgery case of 1997 in Bihar's capital.

Mumbai: Patna police on Tuesday approached a court in Mumbai seeking custody of arrested Pune businessman Hasan Ali Khan in connection with a passport forgery case but their plea was deferred till Wednesday.

The police presented a production warrant of Khan issued by the chief judicial magistrate of Patna as he is required in the passport forgery case of 1997 in Bihar's capital.

Khan's counsel IP Bagadia, however, objected to the plea saying the production warrant was addressed to the Arthur Road Jail in Mumbai and not to the court and hence it should be returned.

However, the State at the instance of Govind Patil, additional senior jailor of Arthur Road made an application saying that the sessions court in Mumbai could direct the jail authorities to send him to Patna court because he was in custody of the court.

Principal Sessions Judge Swapna Joshi deferred the hearing till Wednesday.

Meanwhile, Khan was produced before Joshi who extended his judicial custody till May 7.

In another development, Khan made an application to the court seeking medical assistance for an injury in his leg. He pleaded he was diabetic and needed immediate treatment following which the court decided to hear his plea on May 4.
