CHENNAI: The decision to suspend DMDK leader Vijayakanth from the Assembly session for 10 days and the procedure followed was in consonance with the provisions of the Constitution of India and the Tamil Nadu Assembly Rules and there is no illegality or violation of any right guaranteed to him under the Constitution, the Madras High Court was informed on Friday.In his counter-affidavit filed in response to a writ petition from Vijayakanth, also Leader of the Opposition, challenging the resolution suspending him for 10 days, Assembly Secretary AMP Jamaludeen said “in the Assembly on February 1, Vijayakanth raised his hand, pointed his fingers at the ruling party members and rolled his tongue and tried to threaten them, thus creating a surcharged atmosphere in the House.”The Speaker was of the opinion that the action of Vijayakanth and his party members tended to lower the dignity of the House and after satisfying himself that there was prima facie breach of privilege of the House, suo motu referred the matter to the Privileges Committee. The committee, consisting of the representatives of all the political parties, including Panruti S Ramachandran, the Deputy Leader of the DMDK, at its meeting on February 2, recommended to the Speaker to suspend him for 10 days during the present as also the coming (budget) session. The issue was discussed in the Assembly and the impugned resolution was passed. Such a procedure had been adopted in an earlier occasion also against AK Bose, a member of the 13th Assembly. He was suspended continuously for 10 days during the present and future session, the counter pointed out.
