Calcutta HC Cancels OBC Certificates: PM Modi Says 'Slap On INDI Alliance', Mamata Says She Won't Accept Order
On Wednesday, the Calcutta High Court scrapped several classifications under the 2012 Act of West Bengal for reservation of vacancies in services and posts in the state, deeming them illegal

Prime Minister Narendra Modi on Wednesday hailed the Calcutta High Court’s decision to scrap OBC certificates issued in West Bengal after 2010, calling it a “slap on the INDIA alliance.” He accused the Trinamool Congress (TMC) of issuing OBC certificates to Muslims for “vote bank politics.”

“This was done because the West Bengal government inexplicably gave OBC certificates to Muslims, only for the Muslim vote bank. This vote bank politics, this politics of appeasement, is crossing every limit,” the prime minister stated.

He further added: “They say that Muslims have the first right on the country’s resources. These people are continuously giving government lands to the Waqf Board and asking for votes in return. These people want to reserve 15% of the country’s budget for minorities. They also want to give loans from banks and government tender based on religion. These people are opposing CAA to please their vote bank.”

Bengal Govt Will ‘Not Allow’ Reduction Of OBC Reservations: Mamata

Reacting to the Calcutta High Court’s order, West Bengal Chief Minister Mamata Banerjee said the state government will “not allow” the reduction of OBC reservations for minorities.

“Even today I heard a judge passing an order, who has been very famous. The Prime Minister is saying that minorities will take away the Tapasheeli reservation, can this ever happen? Minorities can never touch the Tapasheeli or tribal reservation, but these mischievous people (BJP) get their work done through agencies, they have got the order through someone but I will not accept this opinion…Those who have given the order should keep it to themselves, we will not accept the opinion of BJP, OBC reservation continues and will always continue…” the TMC supremo said.

‘TMC Granted OBC Reservations To 118 Muslim Castes With Survey’: Amit Shah

Shedding light on the discussion, Union Home Minister Amit Shah accused West Bengal CM Mamata Banerjee of granting OBC reservations to “118 Muslim castes without any survey.”

“Someone went to the court, the court took cognizance of this and all the certificates issued between 2010 and 2024 have been cancelled by the HC. Mamata Banerjee wants to rob the reservation of backward classes for her vote bank and give that reservation to Muslim castes,” the home minister remarked.

Further reacting to Banerjee’s remarks, Shah asked, “I want to ask the people of Bengal, can there be such a Chief Minister, who will say that we do not obey the court’s order? I strongly condemn this and welcome the decision of the High Court and we will definitely ensure that the decision of the High Court is implemented.”

Calcutta High Court Order

On Wednesday, the Calcutta High Court scrapped several classifications under the 2012 Act of West Bengal for reservation of vacancies in services and posts in the state, deeming them illegal.

The court struck down several classifications for reservation as Other Backward Classes (OBC) given under The West Bengal Backward Classes (Other than Scheduled Castes and Scheduled Tribes) (Reservation of Vacancies in Services and Posts) Act, 2012.

According to the new order, OBC certificates issued by the State Government can no longer be used to obtain jobs or benefits. Almost 500,000 OBC certificates have been canceled following this order.

The bench directed that the orders classifying 42 classes made by the state from March 5, 2010, to May 11, 2012, were also quashed, with prospective effect, due to the illegality of the reports recommending such classification.
