Thiruvananthapuram: The Kerala High Court observed that the version of the rape survivor should have been heard while considering the discharge petition of Rajya Sabha Deputy Chairman PJ Kurien in Suryanelli rape case.

The observation was made in a petition filed by the rape survivor that she should be made a party in the case and her version should be heard. The judge has reserved its order in the case.

Advocate Rajendran Nair, the counsel for the rape survivor, said that the earlier judgement of 2006 discharging Kurien was against the principles of natural justice as the girl was not heard.

The infamous Suryanelli rape case of 1996 was that a 16-year-old girl was taken to several places and raped by about 40 men. She had alleged that Kurien was one among those who raped her.

About 35 men were tried in this case and except one all others were acquitted in the case. The Supreme Court had asked the High court to hear the cases afresh in a petition filed by the rape survivor. Repeated police investigations in the past had given a clean chit to Kurien.

The prosecution argued that the case was considered several times at various courts.
