CHENNAI: A public interest writ petition from DMK general secretary K Anbazhagan challenging a GO dated June 22 this year, which constituted a one-man Commission to look into the alleged irregularities in the construction of new Assembly and Secretariat complex was dismissed on Tuesday. The bench, comprising Justices D Murugesan and KK Sasidharan, said that the petition was on the basis that the CM had a grudge against the DMK and to support his claim he had stated instances alleging this. As per the terms of reference, the commission could make only recommendations and they might either be acted upon or might not be acted upon, the bench pointed out. “In our opinion, the averments in the petition and the reply affidavit do not show any public element warranting this court to entertain and decide the points raised in the petition,’’ the bench said and dismissed the petition.The bench, however, admitted and ordered notice on similar writ petitions from DMK sitting MLA Thangam Thennarasu and advocate S Vijayalakshmi. The bench observed that the grounds raised by Thennarasu were arguable and he had made out a case for admission of his writ petition. The grievances of Thennarasu could be looked into after affording an opportunity to the authorities concerned to controvert the challenge, the bench said and ordered notice returnable in two weeks.As regards Vijayalakshmi’s petition, the bench said that it was prima facie convinced that the the issues raised by her were triable by the court and ordered notice returnable in eight weeks.
