As pointed out by senior advocate K Doraisami, it was seen from the information furnished by the State Bank of India under theRight to Information Act, that two cheques were issued by the District Adi Dravidar and Welfare department, Namakkal, one in the name of Thyagarajan’s institution and the other in favour of Pandian Institute of Industrial School.Nothing had been shown on record towards misappropriation of the entire amount by Thyagarajan, Justice GM Akbar Ali observed. Therefore, considering the facts and circumstances of the case and on perusal of the records, I am of the view that no prejudicie would be caused in the event of granting anticipatory bail to Thyagarajan, the judge said, and accordingly granted the relief.In the event of arrest, petitioner should be released on bail on his executing a personal bond for Rs 10,000 with two sureties each for alike sum to the satisfaction of the local magistrate or the police.
