KOCHI: The Chief Judicial Magistrate Court, Ernakulam, on Thursday dismissed a petition seeking a directive to arrest ADGP Mohammed Yasin and IG Vijay Sakhare, who are implicated in the custodial death of Sampath, the accused in the Puthoor Sheela murder case. The petition was filed by Sampath’s brother Murukesan. The court had issued non-bailable arrest warrants against the then Thrissur Range IG Mohammed Yasin and Palakkad SP Vijay Sakhare,the 15th and 16th accused respectively. The CJM court issued warrants against the top cops on March 23 as requested by the CBI team probing the case. Though the CBI team had arrested policemen Ramesh, Unnikrishnan and Ramachandran, the warrant against the top officers was not executed. “There were no sincere efforts on the part of the CBI to execute the non-bailable warrants against the officers who are still threatening and intimidating witnesses using their official capacity. The investigation team did not arrest Yasin and Sakhare though the high-ranking police officers were ‘very much available,’” Murukesan submitted in the petition.The CBI on June 3 had returned the warrants to the court saying that the application for issuance of a warrant of arrest was filed without carrying out the assessment of the evidence collected till then.
