New Delhi: The Delhi High Court on Wednesday directed the Delhi Government to file a detailed reply and action taken report on the steps being taken to ban the use of all non bio-degradable plastic carry bags in the capital.
Alternatively, if the Government was unwilling to implement the ban, the same should be submitted in an affidavit, a Division Bench of Justice M K Sharma and Justice Reva Khetrapal said.
The action was taken after a PIL filed by one Vinod Kumar Jain on behalf of a voluntary organisation Tapas.
In his petition, he sought a ban on the manufacture, sale and use of non bio-degradable plastic carry bags on the grounds that they pose a serious threat to the environmen and cause health hazards to people.
In 2004, the Delhi Plastic Bags (Manufacturer, sales and usage) and Non Bio-Degradable Garbage (Control)(Amendment) Bill, 2004 was brought in by the Government to ban the use of plastic carry bags.
The petition complained that though the Act was initially formulated in 2000 and later amended in 2004, no steps had been taken by the Government to enforce the Act. And as a result it was alleged that there was indiscriminate use of plastic bags in the in the food industry.
