New Delhi: The Delhi High Court on Tuesday refused to ask the Ministry of External Affairs to issue a fresh passport to Bharti Yadav, a key witness in the Nitish Katara murder case.
Yadav, who lives in the UK, wants the Government to issue her a fresh passport as a condition before she deposes on November 25. Yadav's visa to stay in UK expires on November 30.
Upon arrival to India, Yadav will submit her revoke passport to the MEA and then a fresh booklet will be issued.
Her lawyers are saying that she has the intention of coming back to India and in fact even the HC has said that November 26 onwards Bharti’s depositions in the lower court will start on a day-to-day basis.
The HC has restrained the police from arresting or detaining Yadav.
Justice A K Sikri also directed the authorities to provide Bharati all necessary emergency travel documents to facilitate her deposition, which would be conducted on a day-to-day basis.
Nitish Katara was kidnapped and murdered in Ghaziabad, Uttar Pradesh in February 2002. Bharti Yadav's brother Vikas Yadav and cousin Vishal Yadav are the main accused in the case.
Bharti, daughter of UP politician D P Yadav, had repeatedly ignored previous court summons before she finally gave an undertaking to come to India.
