MADURAI: Mala had left her son Giridharan at the child care home run by Shaik Dawood at Sangiliandavapuram, near Tiruchy, after the death of her husband Siva Prakasam in 2009. The child was at the home for about two years during which period she paid `1,000 per month towards maintenance expenses. In May 2011, when Mala decided to go to Villupuram to her brother’s house to live with her child, Dawood allegedly refused to hand over Giridharan, and shifted the child care home to an undisclosed location.Mala moved the High Court after the Tiruchy police failed to act.Meanwhile, Dawood appeared in the court and produced an adoption deed dated February 24, 2010.However, instead of the signature of Mala in the deed, there was a thumb impression and the name was mentioned as R Punitha.Mala’s counsel argued that when a child’s mother is willing to take her minor son along, Dawood cannot be permitted to keep the child.Recording the statements of Mala, the High Court division bench here directed Dawood to hand over the child to her. The bench also directed the police to give protection to Mala and son till they reach Villupuram.
