Some genuine and some not so genuine. As the role of the ABVP--the student wing of the RSS--became clear a demand for sacking the Shivraj Singh government came from the opposition Congress party. Also voices calling for a ban on the RSS could be heard but the most prominent demand doing the rounds these days is for a CBI inquiry into the entire episode. And the campaign to drive this demand home is being spearheaded by Himanshu Sabharwal, the son of the dead professor.


So this brings us face to face with one crucial question? Can a CBI probe actually help nail the real culprits? And according to those, supporting this demand the answer to this question is a big yes. Yes because the CBI is reporting to the Congress government at the centre and the Congress led UPA government wouldn't spare any opportunity to embarrass the BJP government in Madhya Pradesh. The CBI may think otherwise but this is the only reason why a demand for a probe from this investigative agency is being made.
What if there is a change of guard both at the centre and the state tomorrow? Very hypothetical but what if it happens? Suppose there is a BJP led government at the centre tomorrow and as expected the Congress takes charge in Madhya Pradesh? What will be the next demand? Refer the case back to the state CID? Perhaps everyone other then Himanshu Sabarwal would have forgotten the story by that time or there could be a new Sabharwal meeting the same end at some other Madhav College. And the story repeats.
The administrative control of all investigative agencies is with the government of the day but once a case is registered the police is accountable only to the court. So irrespective of whom the investigative agency is reporting to, it remains accountable only to the court. But no one would like to believe this as politicians of our land manage to influence everything under the sun.

Sample this.

Even before the Crime Investigation Department of the MP Police started investigating the murder of professor Sabharwal, Chief Minister Shivraj Singh Chauhan in all his wisdom gave a clean chit to the ABVP saying he did not consider it a murder and that it was an accidental death.

The CID managed to arrest two persons Shashi Ranjan Akela and Vimal Tomar as they were in judicial custody in connection with a rioting case booked on the same day. All the four other accused named in the case so far are from the ABVP and the CID has not been able to arrest them. Everyone knows where these people are but then it's not that easy to raid ministries bungalows.


Witnesses turning hostile is not new to this country but statements of eyewitnesses who have already expressed fear for their lives have not been recorded before a magistrate or under section 164 of the CrPC . The CID instead is busy serving notices under section 160 to those who could have some knowledge about the case.

Public Interest Litigations seeking transfer of the case to the CBI have been filed at Jabalpur and indore and also there is a petition seeking the same that has been filed in the Supreme Court. No guesses, however, for who is behind these PILs.


So everything ranging from demands to probes can be managed in this country and the casualty as always would be justice. Should we wait for another Sabharwal to happen.
