Advocate-General A Navaneethakrishnan on Monday told the first bench of the Madras High Court that the committee constituted to select the chairperson for the TN State Electricity Regulatory Commission (SERC) will not finalise the selection until further orders from the High Court.
The AG told this to the bench consisting of Chief Justice M Y Eqbal and Justice T S Sivagnanam, when the public interest writ petiotion from advocate K Murali Babu of Ambattur came up for hearing on Monday. The bench adjourned the matter till September 24 after recording the undertaking of the AG.
The PIL prayed for a direction to the government to complete the process of appointment of chairperson to the commission by getting suitable names recommended by the three-member selection panel headedby Justice K Sampath within a reasonable time to be fixed by the court. In failure, the petitioner prayed for a direction to the government to act in accordance with Sec 84(2) of the ElectricityAct, 2003, without any delay.
Petitioner contended that the selection committee, even after lapse of eight months, deliberately failed to recommend the names for the post in question, for the reasons best known to it. Hence, it was the duty of the governmenrt to invoke the powers conferred under Sec 84(2) with the prior consultation with the Chief Justice of the High Court.
