Shukkoor murder case: HC grants bail to P Jayarajan

Justice Babu Mathew P Joseph granted the bail and directed Jayarajan to furnish a bond of Rs 25,000 and present two sureties for the like amount.“In view of the fact that the investigation of the case has already been completed and the final report filed, continued detention of the petitioner is not at all required,” the court held.Considering the facts and circumstances of the case, the Director-General of Prosecution did not seriously oppose the bail.However, the court turned down the prosecution’s plea to restrain Jayarajan from entering the Kannapuram police station limits.Counsel for the petitioner M K Damodaran submitted that the investigating team had filed the chargesheet against the 33 accused and various offences, including IPC 302, have been charged against most of them. However, Jayarajan was charged under Section 118 (concealing the design to commit offence punishable with death or imprisonment for life) of the IPC.“He had no role in the murder and has appeared twice before the SIT for hours on end. He was later on taken into custody without being informed of the grounds of his arrest,” Damodaran said.The court pointed out that it had earlier dismissed Jayarajan’s bail plea, when the investigation was in progress.The court also directed the petitioner that he should not directly or indirectly threaten any persons connected with the case or influence any of the witnesses.The court further held that the petitioner should not commit any similar offence after being released on bail, otherwise the order would be cancelled. Considering the Onam holidays, the petitioner sought a directive to be released on Monday itself.The court asked the registry to communicate the order to the Magistrate Court so that the petitioner could obtain the release on Monday.The prosecution pointed out that on February 20, T V Rajesh MLA and P Jayarajan were admitted to the Taliparamba Co-operative Hospital, after their car was attacked by a group of Muslim League workers at Ariyil in Pattuvam.
