CHENNAI: The Madras High Court has restrained VVD & Sons Private Limited at Egmore from using the images of model-turned-actor Kajal Aggarwal in its product promotion advertisements. A bench comprising Justice R Banumathi and Justice R Mala granted the injunction last week while allowing an appeal from Aggarwal challenging the orders dated November 4 this year of a single judge, who refused to grant any stay.Advocate V Manohar contended that Aggarwal entered into an agreement with the company for promoting its products of hair oil and coconut oil through various mediums of advertisements like film, TV, magazines, hoarding, etc., on Decemebr 29, 2008 for one year. However, the company used her images in all forms of advertisements even after the expiry of the agreement in December, 2009. She filed a suit to recover Rs 2.5 crore towards damages from the company and to restrain it from using the ad materials. Before the single judge, the company agreed not to use her images in still photographs or her other profile on any of its products except with her written consent. The judge rejected the interim prayer to restrain the company from using her images in other forms. Hence, the present appeal.The bench, allowing the appeal on December 22, observed that since the term of the agreement was only for one year, the company could not use her images. The company had acquired only limited right of using the reputation of the actress/model, the bench said, and quashed the orders of the single judge.
