BANGALORE: The High Court on Thursday adjourned the bail petition of jailed former chief minister B S Yeddyurappa, who is under judicial custody, till Friday by a Special Lokayukta Court in the alleged land scam cases.Justice B V Pinto adjourned the hearing to October 24, but following a plea by Yeddyurappa’s counsel, agreed to conduct hearing on Friday.Supreme Court senior counsel Uday U Lalit, who is appearing for Yeddyurappa, submitted that the former CM is entitled to bail and had never indulged in tampering with evidence as claimed by the complainants.He said that during Yeddyurappa’s tenure as chief minister, there was not a single instance of him obstructing or hampering the collection of evidence by the complainants or by the Governor’s office.  Citing that the complainants had applied for information under RTI Act, he said, "If he had wanted to obstruct evidence collection, he could have done so long ago.” He further stated that apart from the two complainants, there are just two witnesses of which one of them is from the BDA and one from the department of Urban Development. He contended that the actual parameters for deciding relief for Yeddyurappa should be whether there is prima facie case established against him.Citing that only those who have indulged in serial killing and punishable under section 376 of CPC are not entitled for rape, he said that Yeddyurappa has no other antecedent of criminal history and that the cases and the other case before the Lokayukta police (Bhadra Irrigation case) are the only cases against him.“Liberty of an individual is important to survival of the society,” the counsel stated, trying to drive home his point.Lalit detailed that the complainant had divided each complaint submitted to the Governor into five with three cases each to create an impression that there were several charges against him.“The land was acquired in 1994, but since there was no development until 2010, land owners sought denotification and the decision to denotify is collective.”BSY kin get 2 week extension on bailBANGALORE: The High Court on Thursday extended bail to sons of jailed former chief minister B S Yeddyurappa, B Y Raghavendra and B Y Vijayendra, and his son-in-law R N Sohankumar following a petition filed by them seeking relief from the conditions imposed by the Lokayukta Special Court while granting them bail last Saturday.Counsel for the petitioners Ashok Haranahalli submitted that they need more time to produce documents of the transactions of Dhavalagiri Property Developers and other financial transactions. A single bench headed by Justice B V Pinto heard the petition and extended the relaxation period by two weeks to produce the documents.The Court asked the three accused in the second case to produce documents of transactions of Dhavalagiri Property Developers and Bhagat Homes Pvt Limited from the day it commenced operations till the date of complaint with certification from a qualified chartered accountant and company secretary within the next week.
