BANGALORE: Citing health reasons, former chief minister B S Yeddyurappa managed to not appear before the Lokayuktha Court, which had summoned him in connection with a land denotification case, on Saturday.However, the court directed him to be appear before it on Monday.The court, on August 8, had summoned Yeddyurappa and 14 other accused to appear before the court in connection with a private complaint filed by advocates Sirajin Basha and Balakrishna.Though the other 14 accused appeared before the court, Yeddyurappa, who is the prime accused and is said to be fearing arrest, is yet to appear.Meanwhile, the other 14 accused have filed a bail plea in the court.Yeddyurappa’s advocate Ravi B Nayak filed an application under section 205 of the CrPC seeking his client’s exemption from appearing in court for all future hearings in the case.Nayak cited that the former CM was suffering from diabetes, hyper tension and fever.Judge N K Sudhindra Rao, while exempted Yeddyurappa from appearing only for Saturday’s hearing, asked Nayak to ensure his client’s presence in the court on Monday at 3 pm.Initially, there was no clarity over the exemption petition as Nayak filed it on grounds that the High Court’s order in an anticipatory bail plea was pending.He also cited health reasons as ground for exemption.When the judge asked him to clarify on the exact reason for the application, Nayak, after a break of 15 minutes, withdrew the application he had filed and submitted a memo pleading exemption on health grounds.C H Hanumantharaya, appearing for the complainants, objected to the petition.He argued that the health reason cited was a mere excuse to avoid appearing before court.He asserted that fearing that the anticipatory bail plea pending before the HC would automatically become null and void, Yeddyurappa had not appeared before the court.The former CM’s advocate rejoined that the complainants were politically motivated and were only motivated to see him jailed.Court Reserves Orders on HDK, Anita Bail PleasBANGALORE: The Lokayukta Special Court reserved its judgement on the anticipatory bail plea filed by former chief minister H D Kumaraswamy, in a case relating to renewal of lease to Janthakal Mining Company, till August 30.The anticipatory bail plea order of the former CM’s wife, Anita, too, has been reserved till August 30.She was summoned after a site was registered in her name in a layout developed by Vishwa Bharathi Housing Cooperative Society, after the society was illegally sanctioned 70 acres of government land when her husband was CM.Judge N K Sudhindra Rao reserved the orders till Tuesday.Advocate R L Patil, appearing on behalf of the complainant, Vinod Kumar, argued that bail should not be given to HDK as the mining leases were granted illegally.Hasmath Pasha, the former CM’s advocate, asserted that the complainant did not have proper evidence backing their claims
