A division bench comprising Justices Elipe Dharma Rao and M Venugopal will hear the writ petition challenging the order of the City Police Commissioner refusing permission to Tamil Eelam Supporters Organisation to hold a conference at YMCA grounds in Royapettah on Sunday.
Originally, while passing interim orders on a writ petition from KPR Ramachandran of Nerkundram praying for a direction to the CoP not to grant permission for the conference, the bench on August 10 had directed the CoP to consider the application for permission and pass orders after taking into account all aspects.
Aggrieved, J Anbalagan, an MLA and member of the TESO, filed the present writ petition. The matter will be heard by the same bench on Sunday.
Single Judge declines to hear TESO’s plea
After listening to the arguments of DMK’s senior counsel P Wilson and Advocate-General A Navaneethakrishnan for a little over one hour on the issue relating to permission for TESO conference, Justice N Paul Vasanthakumar of the High Court expressed his inability to entertain J Anbalagan’s petition challenging the orders of the City Police Commissioner refusing permission to hold the conference at the YMCA grounds in Royapettah.
The judge said that the matter was under the consideration of a division bench (comprising Justices Elipe Dharma Rao and M Venugopal).
The judge added that it will not be proper to consider this issue.
LTTE angle
Terrorists and LTTE cadre are likely to participate in the conference to be held at the YMCA grounds on Sunday, Advocate-General A Navaneethakrishnan told the High Court.
He disclosed the shocking news during the course of arguments on the writ petiton from DMK MLA Anbalagan, challenging the CoP’s rejection order for holding the conference.
Producing certain confidential files to Justice Vasanthakumar, Navaneethakrishnan told the judge that the input given by the State Intelligence was very sensitive.
When DMK senior advocate P Wilson gave an assurance and offered to file an affidavit vouching for the safety of people, he said that no assurance could be relied upon. The application given to YMCA for hiring its grounds had stated that it was for DMK conference. But the application for police permission stated that it was for the TESO conference, he pointed out, and added that “something had been hidden”.
Moreover, the ground, which could accommodate just 8,000 people had only one narrow entrance, he contended.
