New Delhi: The Central Information Commission has said that disclosure of answer sheets of examinations conducted by public recruitment and educational bodies are exempted from disclosure under the RTI Act.
The Commission made it clear that institutions like UPSC, Staff Selection Commission, CBSE and state universities do not fall under the purview of the Act and hence can not be asked to disclose evaluated answer sheets of their respective examinations.
"By their own rules and regulations, they (bodies) are prohibited from disclosure of evaluated answer sheets. We therefore decide that in such cases, a citizen can not seek disclosure of evaluated answer sheets under the RTI Act," the Bench was quoted by PTI.
The full bench of the Commission headed by Chief Information Commissioner Wajahat Habibullah was hearing a bunch of RTI appeals seeking disclosure of answer sheets of different examinations.
The CIC while granting exemption to the recruitment and educational bodies considered their contention that divulging such information would render the system "unworkable".
It, however, favoured disclosure of answer sheets of departmental examinations, which it said "may bring in sparent and accountable."
