A police case has been registered against Mahindra Chairman Anand Mahindra and 12 others in Kanpur for “false assurances” on the safety of car. The FIR was registered after a complaint was made by a man (Rajesh Mishra) whose son (Dr Apoorv Mishra) had died following a car accident.
In the FIR, Rajesh Mishra said he bought a black Scorpio worth about Rs 17.40 lakh after believing the company’s claim on its features and safety in advertisements and social media posts by Anand Mahindra. He gifted the car to his only son Apoorv Mishra.
“On January 14, 2022, my son Dr Apoorv was returning to Kanpur from Lucknow in the car. Along with Apoorv, his friends were also in the car and all of them were wearing their seat belts (mentioned in the police report). Because of fog, the car hit the divider and then toppled several times and my son died at the spot,” said the complaint.
According to the FIR, Rajesh Mishra said if the assurances were not given by the dealership and the company in advertisements, he would have never bought the car.
The complainant said that despite the seat belt being worn, the airbags in the car did not open, resulting in his son’s death and that the company had cheated him by giving false assurances. It also said that Mishra found through sources that there were no airbags in the car.
Mishra moved a local court and now an FIR has been registered against Mahindra Chairman Anand Gopal Mahindra and 12 others.
The case has been lodged under various sections of the IPC — Section 420 (cheating), 287 (negligent conduct with respect to machinery), 304-A (causing death by negligence), 504 (intentional insult with intent to provoke breach of the peace), 506 (criminal intimidation), and 102-B (criminal intimidation).
