The state government on Tuesday submitted before the Kerala High Court that the investigation into the Merchiston case has revealed that Xavi Mano Mathew, the second accused and managing director of Southern Field Ventures entered into a criminal conspiracy with the other accused and sold the estate concealing the fact that the land was vested with the state.
The statement was filed in a petition filed by Xavi Mano Mathew seeking to quash all the criminal proceedings pending before Additional Chief Judicial Magistrate Court at Thiruvananthapuram. The state also said that the case against the petitioner cannot be cancelled.
R Mahesh, Deputy Superintendent of Police (Administration), Thiruvananthapuram, said that by concealing the fact that the land was vested in the state from 2000 as per the EFL ordinance and that a case regarding excess land
was pending before the Taluk Land Tribunal, Nedumangad, Xavi Mano Mathew obtained an amount of `455 lakh on a property in which he had no right to sell.
Subsequently, concealing the above facts, the accused sold 81.5 acres of land from the above property to the Indian Space Research Organisation (ISRO) and obtained an amount of `3.26 crore.
The government said that the area was host to many endemic and rare species and that it was declared as fragile land under the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Ordinance and was vested in the government. Hence, neither the petitioner nor any person claimed through him had any manner of right or title in it.
The issue arose in 2007 when the ISRO sought land from the state to set up the Indian Institute of Space Science and Technology in the capital.
